GIFT ACCEPTANCE GUIDELINES
The Texas Industrial Workforce Foundation (TIWF) is grateful for the generosity of individuals, businesses, foundations, employers, and community partners who support our mission.
These guidelines explain the types of gifts TIWF generally accepts and when additional review may be required.
Gifts TIWF Generally Accepts
TIWF may generally accept:
-
Online monetary donations
-
Checks
-
Approved electronic or bank transfers
-
Employer matching gifts
-
Sponsorships
-
Tools, personal protective equipment (PPE), materials, supplies, and equipment that support TIWF programs
-
Other charitable gifts approved by TIWF
All gifts must support TIWF’s charitable mission and be consistent with applicable law and TIWF practices.
Areas of Interest
Donors may indicate areas they are especially interested in supporting, including:
-
Where Needed Most
-
Sponsor a Future
-
Training & Certification Support
-
Tools, PPE & Work Equipment
-
Transportation & Workforce Barrier Assistance
-
TIWF Programs & Operations
-
Other approved TIWF charitable purposes
Donor preferences help TIWF understand areas of interest. Unless TIWF specifically accepts a restricted gift in writing, TIWF retains discretion and control over contributed funds so they may be used in furtherance of TIWF’s charitable mission.
Honor and Memorial Gifts
TIWF welcomes gifts made in honor or memory of another person.
At the donor’s request, TIWF may notify an honoree, family member, or other designated person that a gift has been made.
Honor and memorial gifts support TIWF’s charitable mission and do not automatically direct funds to the honoree or the honoree’s family.
Gifts for Specific Individuals or Private Parties
Charitable contributions to TIWF may not be earmarked for the private benefit of a specific individual, family, employee, employer, business, or other private party.
Donors may support a TIWF program or charitable area of interest, but TIWF independently determines eligibility, selects recipients, and administers assistance.
TIWF will not serve as a pass-through for contributions intended primarily to benefit a specific private individual or organization.
Tools, PPE, Equipment and Other Noncash Gifts
TIWF may accept useful noncash gifts such as:
-
Tools
-
PPE
-
Training equipment
-
Work equipment
-
Materials
-
Supplies
-
Other property that directly supports TIWF programs
Before accepting a noncash gift, TIWF may consider:
-
Whether the gift supports TIWF’s mission
-
Whether TIWF or program participants can reasonably use it
-
Condition and safety
-
Storage or transportation requirements
-
Maintenance or repair costs
-
Whether the property can reasonably be distributed or sold
-
Potential liability or other obligations
TIWF is not required to accept donated property simply because the property has value.
Vehicles, Real Property and Other Special Gifts
Please contact TIWF before transferring a vehicle, real property, or other unusual or significant noncash gift.
TIWF may review factors such as:
-
Ownership and title
-
Liens or debt
-
Condition
-
Safety
-
Storage
-
Transportation
-
Insurance
-
Maintenance
-
Taxes
-
Environmental concerns
-
Legal liability
-
Restrictions
-
Cost of ownership or disposal
-
Whether the gift can reasonably advance TIWF’s mission
TIWF may decline a proposed gift when the expected cost, risk, restrictions, liability, or administrative burden outweighs its charitable benefit.
Valuation of Noncash Gifts
Donors are responsible for determining the value of donated property for their own tax purposes.
TIWF does not:
-
Appraise donated property for donors
-
Guarantee a donor’s claimed value
-
Determine the amount of a donor’s tax deduction
-
Provide individualized tax, legal, accounting, or appraisal advice
TIWF’s acknowledgment of a noncash gift will generally describe the property received without assigning a tax value to it.
Restricted or Conditional Gifts
TIWF may decline a gift containing restrictions or conditions that:
-
Conflict with TIWF’s charitable mission
-
Are difficult or impractical to administer
-
Create excessive costs or obligations
-
Provide improper private benefit
-
Interfere with TIWF’s independent charitable judgment
-
Create unreasonable legal, financial, or operational risk
Any significant restriction should be discussed with TIWF before the gift is made.
TIWF’s Right to Decline a Gift
TIWF may decline any gift that:
-
Does not advance its charitable mission
-
Creates unreasonable cost or liability
-
Contains unacceptable restrictions
-
Presents legal or financial concerns
-
Creates an actual or potential conflict of interest
-
Could result in improper private benefit
-
Is unsafe, unusable, or excessively burdensome
-
Is otherwise not in TIWF’s best interests
Declining a gift does not reflect negatively on the donor or the value of the property offered.
Gift Acknowledgments
TIWF will provide appropriate acknowledgment of accepted charitable contributions.
For monetary gifts, acknowledgments may state the amount received.
For noncash gifts, acknowledgments will generally describe the property received without assigning a dollar value for tax purposes.
When a donor receives goods or services in connection with a payment, TIWF will provide applicable disclosures when required.
Questions About a Gift
If you are considering a noncash, restricted, unusual, or significant gift, please contact TIWF before transferring the property or completing the transaction.
